Welcome to The Nihon Review. These Terms of Service (“Terms”) govern your access to and use of https://www.nihonreview.com/ (the “Site”), operated by an individual based in California, United States (“The Nihon Review,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

1. About the Site

The Nihon Review publishes reviews, commentary, and related editorial content about anime and other Japanese media. All reviews, ratings, and recommendations reflect the personal opinions of their authors. They are provided for informational and entertainment purposes only and are not statements of fact about any work, company, or person.

2. Eligibility

You must be at least 13 years old to use the Site. If you are under the age of majority where you live, you may use the Site only with the involvement of a parent or legal guardian. Some reviews discuss mature themes; viewer discretion is advised.

3. Our Content and Intellectual Property

Unless otherwise noted, the text, ratings, original graphics, logos, and site design on the Site (“Our Content”) are owned by The Nihon Review or its contributors and are protected by copyright and other laws. You may:

  • View and read Our Content for your personal, non-commercial use; and
  • Share links to Site pages and quote brief excerpts with clear attribution and a link back to the original page.

You may not copy, republish, scrape, sell, or create derivative works from Our Content, including republishing full reviews or using Our Content to train machine learning or artificial intelligence models, without our prior written permission.

4. Third-Party Intellectual Property

Anime titles, characters, screenshots, key art, logos, and other materials referenced on the Site are the property of their respective owners, including studios, publishers, and licensors. We use limited portions of these materials for purposes of criticism, commentary, and review, which we believe constitutes fair use under U.S. copyright law. Their use does not imply any affiliation with or endorsement by the rights holders.

5. Copyright Complaints (DMCA)

We respect the intellectual property rights of others. If you believe material on the Site infringes your copyright, please send a notice to Contact Page that includes:

  • Your physical or electronic signature;
  • Identification of the copyrighted work you claim has been infringed;
  • Identification of the material on the Site you claim is infringing, including its URL;
  • Your contact information (address, telephone number, and email address);
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

We will review valid notices and remove or disable access to material where appropriate.

6. Comments and User Content

The Site may allow you to post comments and other content (“User Content”). You are solely responsible for your User Content. By posting User Content, you:

  • Confirm that you own it or have the right to post it;
  • Grant us a non-exclusive, worldwide, royalty-free, perpetual license to display, reproduce, edit for length or formatting, and distribute it in connection with the Site; and
  • Understand that it will be publicly visible along with your display name.

When posting, you agree not to:

  • Post content that is unlawful, harassing, hateful, threatening, defamatory, obscene, or invasive of another person’s privacy;
  • Post unmarked spoilers in comment sections where the review is marked spoiler-free;
  • Post spam, advertising, or links to pirated or illegally distributed content;
  • Impersonate any person, or misrepresent your affiliation with any person or organization;
  • Post malware or attempt to interfere with the Site’s operation or security; or
  • Post anyone else’s personal information without their consent.

We may moderate, edit, refuse, or remove any User Content, and block any user from commenting, at our sole discretion and without notice. We are not obligated to monitor User Content and are not responsible for content posted by users.

7. Prohibited Uses of the Site

You agree not to:

  • Use the Site for any unlawful purpose;
  • Use bots, scrapers, or other automated means to access or collect content from the Site, other than standard search engine indexing that respects our robots.txt file;
  • Attempt to gain unauthorized access to the Site, its servers, or any related systems; or
  • Overload, disrupt, or impair the Site or interfere with other users’ use of it.

8. Newsletter and Communications

If you subscribe to our newsletter, you agree to receive emails from us. You may unsubscribe at any time using the link included in each email.

9. Third-Party Links, Embeds, Advertising, and Affiliate Links

The Site contains links to and embedded content from third-party websites and services, such as YouTube, streaming platforms, and social media. We do not control and are not responsible for third-party content, products, services, or privacy practices. Your use of third-party websites is at your own risk and subject to their terms.

The Site does not currently display advertising or contain affiliate links. In the future, we may display advertisements (for example, through Google AdSense) and include affiliate links, through which we may earn a commission on qualifying purchases at no additional cost to you. If we do:

  • Affiliate relationships will be disclosed on the pages where affiliate links appear, consistent with the U.S. Federal Trade Commission’s endorsement guidelines;
  • Advertising and affiliate relationships will not influence our editorial opinions, reviews, or ratings; and
  • Any purchase you make through a third-party link is a transaction solely between you and that third party.

10. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not guarantee that the Site will be uninterrupted, error-free, secure, or free of viruses, or that information such as release dates, episode counts, streaming availability, or credits is accurate, complete, or current.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE NIHON REVIEW AND ITS OPERATOR, WRITERS, AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless The Nihon Review and its operator, writers, and contributors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your User Content, your use of the Site, or your violation of these Terms or of any law or third-party right.

13. Changes to the Site and These Terms

We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time by revising the “Last updated” date above. Your continued use of the Site after changes are posted means you accept the revised Terms.

14. Termination

We may suspend or terminate your access to the Site, including your ability to comment, at any time and for any reason, including violation of these Terms. Sections 3, 4, 6, and 10 through 16 survive termination.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts. Before filing a claim, you agree to first contact us at the email below and attempt to resolve the dispute informally for at least 30 days.

16. General

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site. If any provision is found unenforceable, the remaining provisions will stay in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our consent; we may assign them without restriction.
